ControlMaxx ("we", "us", or "our") is a service operated by Vergara Investment LLC. This Privacy Policy explains what information we collect when you use our GPS tracking service, mobile applications, and website at controlmaxx.com (collectively, the "Service"), how we use that information, and the choices you have.

2.6 Push notification token (mobile app)

If you install the ControlMaxx mobile app and enable push notifications, your device generates a token that we store on your account so we can deliver notifications you've subscribed to (geofence alerts, low battery alerts, etc.). Tokens can change; we update our records when your device sends a new one. You can disable push notifications in your device's system settings at any time.

2.7 Email engagement

When we send you transactional email (welcome emails, password resets, account notifications), our transactional email provider records delivery status and may record opens. We use this only to confirm successful delivery and troubleshoot bounced emails.

We may disclose your information if required by law (e.g., subpoena), to protect our legal rights, or to investigate suspected fraud or violation of our terms.

Your data is stored on servers located in Ashburn, Virginia, USA, operated by our hosting provider. Other service providers may store their respective portions of your data in their own facilities, which may include locations outside the United States. By using the Service, you consent to your data being transferred and processed in the United States.

Depending on where you live, you may have legal rights regarding your personal information:

California residents have additional rights under the California Consumer Privacy Act (CCPA), including the right not to be discriminated against for exercising these rights. We do not sell personal information as defined under CCPA.

Residents of the European Economic Area, the United Kingdom, or other jurisdictions with similar data protection laws have additional rights under those frameworks.

8. Account and data deletion

You can request deletion of your account at any time by:

  1. Logging in and using the cancellation flow in Settings → Account → Subscription, which schedules your account for deletion at the end of your billing period, OR
  2. Emailing support@gpsnvision.com and requesting deletion.

The Service is not directed at children under 13, and we do not knowingly collect personal information from anyone under 13. If you believe we have collected information from a child under 13, please contact us at support@gpsnvision.com and we will delete it.
